Sentencing regime

ACT:

  • the recruitment, transportation, transfer, harbouring or receipt of persons (What is done?).

  • These actions must be taken with the intent to exploit the persons.

MEANS:

  • refers to the use of force, coercion (violent, non-violent, psychological), deception, or other forms of abuse of power or vulnerability to obtain control over the person (How it is done?).

  • This may include the use of incentives, controlled substances drugs and medication, debt bondage, threats, violence, or other forms of intimidation to force a person into trafficking

PURPOSE:

  • refers to the goal of trafficking, which is exploitation. (Why it is done?).

  • Exploitation can take many forms, such as sexual exploitation, forced labour, criminal exploitation, removal of organs, slavery etc.

When the victim is a minor (under 16) only an ACT + PURPOSE need to be present for a human trafficking crime to occur.

Here are key indicators to watch for:

Signs of Human Trafficking

  • Individuals are not allowed to move freely or are accompanied by someone controlling their actions.

  • No access to personal identification, such as ID cards or passports.

  • Unexplained injuries, bruises, or signs of neglect and malnutrition.

  • Victims may avoid eye contact, appear anxious, or seem overly submissive.

  • Someone else speaks for the individual or monitors their interactions.

Signs of Human Smuggling

  • Individuals arriving under unusual circumstances or using falsified travel documents.

  • Evidence of financial transactions for illegal entry into a country.

  • People in poor health due to dangerous and unsanitary travel conditions.
